Please clarify the following:
1)Is it mandatory to transfer the bid security amount (1% of the bid value) to the contracting authority’s bank account, or is it acceptable to provide the bid security in the form of a hard copy document (e.g., a bank guarantee)?
2)At which stage must certificates or other documents issued by authorized bodies, confirming the compliance of goods (with clear reference to relevant standards or specifications), be submitted: at the bid submission stage, upon contract signing, or during contract execution?
1) According to point no. 18 (subpoint no. 4) of the Procurement Notice, the bid security in the amount of 1% of the bid amount excluding VAT shall be presented in the form of bank transfer to the account of the contracting authority.
2) In case PSA, under the provisions of art. 20 para. (8) Law no. 131/2015 on public procurement, will require to provide supporting documents, stipulated in ESPD/DUAE, the economic operator is obliged to submit them within a period of up to 7 calendar days, according to the normative framework in force. In case of failure to submit the supporting documents within the deadline set, the economic operator will be disqualified.
Regarding the Self-declaration concerning the Ownership of intellectual property rights over all protected objects related to the purchase object and Certificate concerning the compliance with the information security management system ISO 27001, economic operator is obliged to present them on the date of bid opening.
Could you please confirm the deadline for paying the 1% bid security?
In accordance with the provisions of art. 68 paragraph (1) of Law no. 131/2015 on public procurement, the submission of the offer means the submission in a common set of the technical proposal, the financial proposal, the DUAE and, where applicable, the bid security. Thus, the 1% bid security, confirmed by bank transfer to the account of the contracting authority, should be submitted by the deadline for submitting of the offers (12.06.2025).
Note: Non-residents will include the bank commission amount in the transferred amount to confirm the 1% of bid security.
In case of a non-resident bidder, whose documents required under the Procurement Notice are to be submitted electronically by its authorized representative holding an electronic signature recognized in Moldova, what is the necessary form for such documents?
Given that the Procurement Notice and the DUAE require all documents to be confirmed by an electronic signature valid in Moldova, is there any requirement for documents issued abroad to be notarized, apostilled (assuming they are duly confirmed with a Moldovan-recognized electronic signature)?
It is enough electronic copy of the hand-signed paper document without the application of the electronic signature or the document confirmed by electronic signature of the economic operator (electronic signature recognized on the territory of the Republic of Moldova)
Where the supporting documents are submitted on behalf of a non-resident bidder by its authorized representative acting under a Power of Attorney, in what form must the respective Power of Attorney be issued? Is notarization and apostille required, or is it sufficient for the document to bear the signature and seal of the bidder (non-resident entity)?
The respective Power of Attorney must have the signature and the seal of the bidder (non-resident entity), the apostille is not required.
The current technical specifications for license plates include a set of specific security features. Could you please clarify who holds the copyright over these features? Is separate authorization required for their use, or is the right to use such features automatically granted to the successful bidder under the awarded contract?
The copyright and usage rights for the specific security features included in the current technical specifications are held or managed by the contracting authority. The right to produce these features is automatically granted to the successful bidder as part of the awarded contract.
No separate authorization is required, and all necessary usage rights are provided within the scope of the contractual agreement.
